Permission requirements are established by MSSD for students who have reached the Age of Majority (18 years). Parental/ guardian permission is required for students under the Age of Majority.

B. LEVEL III – CODE OF CONDUCT VIOLATIONS

1.  Assault

  1. Physical

 

A. Physical attack on any person.

 

A. 1st offense – 5 days in ESSP
2nd offense- 10 days in ESSP
3rd offense – Level IV

  1. Sexual Misconduct

B. Sexual harassment, inappropriate conduct with sexual intent and without consent.

B. 1st offense – 10 days in ESSP
2nd offense – Level IV

2. Sexual Acts

Sexual acts committed with mutual consent of both parties.

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

3. Drug/Alcohol

Use, possession, and accessory: The possession of or use of any alcohol, controlled substance, and paraphernalia. 

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

4. Tobacco Use

Use, possession, and accessory: The possession or use of any tobacco product.

1st offense- 3 days in ESSP
2nd offense – 5 days in ESSP
3rd offense – 10 days in ESSP

5. Fire Safety

Tampering, misuse of any fire and other safety equipment, and accessory.

1st offense – 10 days in ESSP
2nd offense – Level IV

6. Fireworks

  1. Possession

 

A. Possession of fireworks.

A. 1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

  1. Detonation

B. Detonation of any fireworks.

7. Theft

Petty larceny on campus – value is less than $100.00. Restitution will be applies in all cases.

3rd offense – Level IV

8. Extortion

Obtaining property from another person, with or without that person’s consent, induced by wrongful use of force or fear.

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

9. Destruction or damage of property

Act or attempted act of willful destruction of school or private property. Restitution will be applies in all cases

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

10. Hazing

Action taken or situation created, intentionally, unintentionally, or recklessly, for the purpose of pledging, being initiated into, affiliating with, holding office in, or maintaining membership in any organization whose members are or include students directed against another individual or group of individuals that endangers the mental or physical health, well being, and/or safety of a student, or result in humiliation, embarrassment, ridicule, intimidation, and shame or which violates any federal or local statute or MSSD policy

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

11. Harassment

Actions detrimental to the welfare of others based on: ethnicity, gender, sexual orientation, race, disability, or religion.

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

12. Threats

Act of making threats, verbally or physically, to do bodily harm for any reason.

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

13. Dishonesty

Cheating, plagiarism, cooperating with another student by allowing him or her to look on or copy a test, homework, etc., forging notes/passes from parents or guardians, teachers, staff members, or office personnel, placing prank calls, falsification of travel plans or sign-out designation

1st offense – 3 days in ESSP
2nd offense – 5 days in ESSP
3rd offense – 10 days in ESSP
4th offense – Level IV

14. False Information

Refusal to give identification or giving false identification when requested to do so by a staff member or authority. Giving false information to a staff member when being interviewed.

1st offense – 5 days in ESSP
2nd offense – 10 days in ESSP
3rd offense – Level IV

15. Disruptive Behavior

Action detrimental to the effective operations of the school.

1st offense – 3 days in ESSP
2nd offense – 5 days in ESSP
3rd offense – 10 days in ESSP
4th offense – Level IV

16. Insubordination

Rebelliousness, unruliness, and disregard of rules; failure to appear in Monday Night Hall; and repeated violations of Levels I and II

1st offense – 3 days in ESSP
2nd offense – 5 days in ESSP
3rd offense – 10 days in ESSP
4th offense – Level IV

17. Leaving MSSD campus/ Unauthorized Area

Leaving campus without permission during school and dormitory hours. Does not follow all procedures related to leaving MSSD campus and access to unauthorized areas.

3rd offense - Level IV

LEVEL IV – CODE OF CONDUCT VIOLATIONS

Major Violation Code

Definition

1. Arson

The deliberate setting of a fire on Kendall Green property

2. Assault

 
  1. Physical

A. Gross physical attack on any person or 3rd offense of Level III Assault.

  1. Sexual (rape)

B. Sexual act committed without consent.

  1. Sexual Misconduct

C. Gross act of sexual misconduct or 2nd offense of Level III Assault.

3. Bomb

 
  1. Threat

A. Any communication to school authorities related to the placement of the bomb or threat to place a bomb on Kendall Green.

  1. Possession of Bomb

B.  The possession of any bomb

  1. Detonation

C.  The act of detonating a bomb on Kendall Green.

4. Drug/Alcohol

  1. Sale, Distribution, or Exchange;

 

A. Including making or adapting illegal or non-prescribed substances, and the sale or exchange of alcohol and/or drugs.

  1. Use, Possession, or Accessory

B. 3rd offense of Level III Drug/Alcohol

5. Fire Safety

  1. False Alarm

 

A. Triggering a fire alarm or initiating a report of fire or emergency without valid cause, or accessory to this offense

  1. Tampering, Misuse of any fire and other safety equipment. 

B. 2nd offense of Level III Fire Safety

6. Sexual Acts

3rd offense of Level III Sexual acts.

7. Weapons

  1. Use

 

A. The act of using a weapon or any instrument to inflict bodily harm.

  1. Possession/sale/distribution

B. The act of possessing, selling, or distributing weapons or instruments that could be used to inflict bodily harm.

8. Fireworks

  1. Possession

A. Gross possession of fireworks products or 3rd offense of Level III Fireworks

  1. Detonation

B. Gross detonation of fireworks or 2nd offense of Level III Fireworks

9. Theft

2nd offense petty larceny on campus–value is less than $500; 1st offense grand theft on campus– value is more than $500 or arrested by local police for shoplifting off campus regardless of property value.

10. Destruction or damage of property

Gross act or attempted act of willful destruction of school or private property or 3rd offense of Level III Destruction or damage of property

Gross actions detrimental to the welfare of others based on: ethnicity, gender, sexual orientation, race, disability, or religion, or 3rd offense of Level III Harassment
